Filing with an ITIN? What you can and can’t claim in 2026

1 · The golden rule

Always separate: taxpayer requirements vs. the child’s requirements

Most ITIN confusion comes from mixing two different things: what the law requires of the taxpayer (you) and what it requires of the dependent (your child). For example: for the Trump Account, the SSN and citizenship are required of the child — you can have an ITIN. For the Child Tax Credit, starting in 2025 the SSN is required of you as well.

2 · What you CAN do with an ITIN

More than many people think
  1. File your taxes and stay compliant — which also builds your tax history.

3 · What you CANNOT claim with an ITIN

And the exception few people know
  1. Child Tax Credit (CTC) and the additional credit (ACTC): starting with tax year 2025, the taxpayer needs a valid SSN. With an ITIN you can’t claim it, even if your child has an SSN.
  2. Earned Income Credit (EIC): never available to ITIN filers.
The exception: on a joint return where your spouse has a valid SSN, the CTC may be possible. And for other dependents there are credits whose eligibility depends on your specific case. Don’t guess: bring us your situation and we’ll run the numbers with you, line by line.

Common doubts, straight answers
Yes. The citizenship and SSN requirements apply to the child, not the parent. On Form 4547 you enter your ITIN and the filing proceeds the same way.
The July 2025 law (One Big Beautiful Bill) requires, starting with tax year 2025, that the taxpayer have a valid SSN to claim the CTC and the additional credit (ACTC). Before, the child’s SSN was enough; now the taxpayer needs one too.
It can change a lot. On a joint return where one spouse has a valid SSN, the credit may be possible. That’s exactly the kind of case worth reviewing with us before you file.
